What are the types of Income tax returns under IT Act 1961 ?

Income tax returns

In this article I shall be discussing the Income tax returns as well as the benefits of filing the returns within the relevant due date.

An original return under Section 139(1) is termed as one that is filed on or before the due date of return. Individuals and businesses, not required to get their books of accounts audited are required to file their Income tax returns?before 31st July of the assessment year. Companies, individuals and firms that are subject to audit as well as partners of such firms are required to file their Income tax returns?on or before 30 September of the assessment year.

A belated return as per section 139 (4) is one that is filed beyond the due date. As mentioned above once a return is filed late, it will be termed as the final return and can never be revised.

  1. Penal interest at 1% per month or part of a month for late filing will be levied u/s 234A. The interest amount is computed on the balance tax payable at the time of filing of Income tax return.
  2. Business losses, Speculation loss, capital gains losses and losses from owning and maintaining race horses cannot be carried forward to future assessment years if the Income tax return?is filed late.
  3. The Due date of income tax return is relevant to related to capital gains tax saving schemes u/s 54, 54B, 54F and even capital gain saving account deposit scheme.
  4. Interest on IT refunds u/s 244A may not be paid by the department if the Income tax return?is belated.

A revised return u/s 139(5) is one that is filed within the due date of filing of return but is corrected later on. Such revised return will replace the original return in all respects except only the date of filing the return. The time limit for filing the revised Income tax return?is one year from the end of the relevant assessment year or before the completion of assessment, whichever is earlier. Therefore, a return for the year ended 31st March 2012 i.e. A.Y. 2012 ? 13, that needs to be revised can be done so till 31st March 2014 or before the completion of the assessment whichever is earlier.

Revision of returns is permitted only if the original one was filed on or before the due date. Revision can also only happen if there is an error of omission or if the error is not on purpose.

It is important to note that the penal interest u/s 234A as mentioned earlier will not be applicable in case of a revised return as it replaces the original return in all respects. Therefore, since the original income tax return?is one that is deemed to be filed within the relevant due date, the question of penal interest for late filing will not be applicable in case of revised returns filed after the due date.

A return cannot be simply revised by filing a letter with the AO without actually filing the revised return. In the case of Goetze India v/s CIT, the company sought to claim a deduction in the original return by simply filing a letter with the Assessing Officer. It was held that the deduction was disallowed as there was no provision in the Act that allowed an assessee to make an amendment in the return without filing a revised return first.

In case a person has suffered any losses under the head ?Profits and gains or business and profession? or under capital gains, such person is required to file a loss return u/s 139(3) on or before the due date of filing of the return of income. It should be noted that the time limit applies to only business losses and capital losses.

However, the following losses can still be carried forward to future assessment years even if the Income tax return?is filed late i.e. loss from house property& business loss on account of unabsorbed depreciation & capital expenditure on scientific research.

Dating Don'ts: How Not To Get Dumped | Clutch Magazine

I believe I?ve made it clear how I feel about relationship advice. Mostly, I find it utterly unhelpful. I think that relationships are so complicated and personal, that advice is not one person fits all. I especially hate gimmicky, quick-fix relationship advice that?s like ?The Magic Thing That Will Get You Married In 364 Days!? WORST! The only brand of dating advice I can stomach is the kind that?s empowering. And when I stumble upon it, I share it with you.

Last week, I had coffee with a good friend. We both started dating new guys we met online on the exact same day. (Weird, right?) That was a few months ago, and both relationships are still on and popping. During our coffee session, one of the things we talked about was how we both were having persistent, irrational anxiety about our relationships suddenly ending. Our shades of anxiety were a bit different. Mine has been taking the form of a recurring fear of being dumped out-of-the-blue.

The script in my head goes like this:

He didn?t text me back. That must mean he?s going to dump me. He said he wants to tell me about something. Is he going to dump me? He told me he needs to push back our meeting time for tonight. He must be thinking about dumping me.

OK. Now, you know my shameful self-script. I know it?s ridiculous. It?s not based in reality. It has nothing to do with my guy or his behavior. He didn?t text me back because he was?sleeping.?He wanted to tell me about something that happened?at work.?He pushed back our meeting time because he wanted to?clean his apartment before I came over.

My fears are based on things that have happened to me in the past. Specifically, the several times I got dumped out-of-the-blue, twice by people I was in unabashedly in love with. My way of dealing with the past hurt was to be hyper-vigilant in all future relationships. I?m constantly afraid I?m missing a sign or a cue like I might have in the past.

I?ve diagnosed myself with Post Traumatic Dating Disorder. Not to make light in any way of the Post Traumatic Stress Disorder and it?s severe and often debilitating symptoms, but years of relationship disappointments can create their own emotionally traumatic side-effects. This particular brand of insanity, I blame on my PTDD.

Pursuant to our conversation, my friend sent me a relationship advice column, unearthed from the deep recesses of the internet, entitled?Dr. Rob?s Simple Advice To Ladies So You Don?t Get Dumped.

When asked for some advice to help women in their relationships Dr.?Rob Dobrenski, Ph.D.?says:

?A few years ago a large portion of my clientele was women, aged 21-35 or so. Most of them had what seemed to be potentially great relationships with their boyfriends. However, all the women had a common feature: a need ? for constant reassurance of the relationship?s stability ? The women would come to me seeking ways to lower their anxiety levels, feel less jealous about ex-girlfriends, develop ways to not freak out that their partner didn?t say ?I love you? often enough. I will tell you exactly what I told each of them ?There are no magic words, no breathing or muscle relaxation techniques, no amount of drugs (recreational or medicinal) that can take away all of the angst and distress if you insist on making a small number of erroneous and perhaps not entirely conscious assumptions.?

So what are these erroneous assumptions that are preventing women from enjoying our potentially great relationships? According to Dr. Rob the main one is that there is such a thing as a ?guarantee? in relationships or life in general.

NAIL ON HEAD. It?s fucking scary to think about losing someone you?ve really started to like. Instead of coming to terms with this, I?ve been putting all my energy into micro-monitoring every single word exchanged between me and the boy instead of dealing with the real issue: the terrifying truth that there are no guarantees in life. I?ve been wasting my time. I need to stop.

But there is hope for me. Dr. Rob goes on to say:

?The good news is that once you?ve eliminated the aforementioned assumptions from your mind set, all the ?symptoms? will go away. No more worry ? finally some fucking inner peace. Why? Because you?ll know that while it?s painful to lose someone important to you, loss is a part of life and that you can be okay with that fact. You can and will move forward, as hard as it may be.?

Dr. Rob, I don?t know you, but can I hug you?

Hey Ami, YOU HAVE NO CONTROL OVER THE FUTURE OF THIS RELATIONSHIP, NOW GET OVER YOUR DAMN SELF AND GET ON WITH IT!

ECB's Draghi to face German lawmakers

(AP) ? European Central Bank president Mario Draghi meets German lawmakers Wednesday as he tries to win over public opinion for a controversial bond-buying plan that is designed to keep a lid on the borrowing costs of indebted countries, such as Spain and Italy.

Last month, the ECB announced its intention to buy unlimited amounts of short-term bonds of troubled euro economies, but its plan met with skepticism in Germany and resistance from the head of the country's central bank. The bond-buying will be triggered when countries apply for help from European rescue funds ? which impose conditions for granting aid.

Draghi plans a closed-doors meeting in Germany's Bundestag, or lower house of Parliament, with members of the budget, finance and European affairs committees. He and the Bundestag's speaker, Norbert Lammert, plan to make public statements afterward.

Even though the government of Chancellor Angela Merkel supports the plan, Bundesbank President Jens Weidmann argues that they come too close to using the ECB's power to print money to support governments' finances directly, which the bank isn't allowed to do. And there are worries in Germany that unlimited bond purchases could undermine the ECB's official mission of fighting inflation.

Joerg Asmussen, an ECB executive board member who was previously a German deputy finance minister, told ARD television that "we are clearly within our mandate" and that Draghi, an Italian, considered it a "great honor" to appear before the country's lawmakers.

"Firstly, he will listen to lawmakers' concerns about the policy of the ECB; secondly, he will explain what we are doing, that we are an independent central bank that makes decisions for the eurozone as a whole," Asmussen said. "And he will discuss with lawmakers how they see the road to completing the currency union."

No country has yet sought to tap the new ECB program, though Spain faces pressure to do so amid unrelenting economic gloom. Germany's Parliament would have to approve any application for money from the 17-nation eurozone's own rescue funds.

Kids react to politics: 'They're like five-year-olds fighting over a toy'

"I don't even know what politics are," appears to be the key utterance in the latest episode of "Kids React," a YouTube-based web series by?hilarious (and talented) producer team Fine Brothers.

As in previous episodes, kids ages 6 to 13?are shown some clips related to the latest news phenomenon, then interviewed for the amusement of us older folks. The youngsters' reactions are typically a mix of precious, silly, ridiculous and insightful?? and this pattern continues in the most recent episode, during which clips connected to the race to the White House were shown.

"This is like middle school, where you get bullied," points out one of the kids, after seeing a campaign ad.?"They're like five-year-olds fighting over a toy ??except the toy is America," adds another.

The entire campaigning process seems odd to these brutally honest kids. Why on Earth would anyone want to be President, wonders one of them.?"Even rappers make more money than the President," after all.

Legal Theory Blog: O'Rourke on Overdelegation in Criminal Procedure

Anthony O'Rourke (SUNY-Buffalo Law School) has posted Structural Overdelegation in Criminal Procedure (Journal of Criminal Law and Criminology, Forthcoming) on SSRN. Here is the abstract:
    In function, if not in form, criminal procedure is a type of delegation. It requires courts to select constitutional objectives, and to decide how much discretionary authority to allocate to law enforcement officials in order to implement those objectives. By recognizing this process for what it is, this Article identifies a previously unseen phenomenon that inheres in the structure of criminal procedure decision-making.

    Criminal procedure?s decision-making structure, this Article argues, pressures the Supreme Court to delegate more discretionary authority to law enforcement officials than the Court?s constitutional objectives can justify. By definition, this systematic ?overdelegation? does not result from the Supreme Court?s hostility to protecting criminal procedure rights. Instead, it arises from a set of institutional pressures that, in combination, differentiate criminal procedure from other forms of constitutional decision-making.

    By identifying the problem of structural overdelegation, this Article clears away much of the confusion that complicates normative debates about the Supreme Court?s criminal procedure decisions. Why does the Supreme Court so frequently grant discretionary authority to law enforcement institutions that other observers find untrustworthy? How can one tell whether the Court has granted ?too much? discretion to law enforcement officials, and what does that phrase even mean? By turning attention to criminal procedure?s structure, this Article offers a framework for answering these questions, and for deepening our understanding of criminal procedure decision-making.

The XBOX 360 outside the USA is not worth to buy.

Yep, that?s right, and I?m going to prove that fact. Players living outside the USA or the UK should think before they buy this console.

But wait! Stop raging, I don?t want to start a flame war here. The PS3 and the XBOX360 are equally good. The problem is the provider. The monopolist Microsoft is starting to get more and more disgusting when talking about business and cash into their pocket. Since their console is usually bought by players from the USA, they think that caring about other countries is bullshit.

Let?s do a little comparison here, what MS offers to the USA and let?s say a smaller country, like mine, Hungary:

  • Both countries have XBL Gold available. I would?ve ripped my hair apart if I had no Gold here.
  • Both countries have Downloadable games, Arcade games, DLCs and Demoes. But in Hungary, the 1/4 of all are not available.
  • USA has tons of Apps, for YouTube, events, sports, gaming video blogs, etc. In Hungary, we get 4 apps: Internet Explorer, Video Studio, VideoKinect, and DailyMotion. Seriously, Hungary gets DailyMotion, but no YouTube. So let?s just say no.
  • USA gets Zune for Music, Videos, Films, etc. Hungary has nothing like that. Not even a single mosquito fart amount of that.
  • USA gets all the good and cheap Indie Games. I don?t get the fact why Hungary wouldn?t have Indie Games. To not make Indie Games get more cash from more countries? I seriously don?t get it.
  • XBOX Rewards is available to the USA, but of course, not for Hungary. In this year?s August, they?ve asked the users, which country should be the next getting this feature. Hungary had the most votes. Guess what. They?ve done nothing about it!
  • And what about TV providers? I don?t think I should continue this. You already get the point.

The only thing that goes in the opposite way is the advertisement. USA accounts have 1 block of ads showing up on their screen. Hungarians have that too, but only connected to gaming news. I?ve heard a lot of players from USA ranting about the ads, all I can tell them is to shut up and enjoy the features that I cannot.

Conclusion:

We, other countries pay the same amount of money (sometimes even more) for the Gold subscription of theirs, but we don?t get all the features we?ve payed for. Why do we have to pay for, then? We only pay for Multiplayer I guess. While the user from the USA watches a Movie with the family, I don?t want to just sit there and play Call of Duty and Battlefield all alone. They could fix all of this ripoff by just sitting in front of their computer and do what they are paid for. To think about the users and not the money? wait? What am I saying? Microsoft is a monopolist company, that won?t happen.

Go get a PC. It has everything you need. Sometimes even more.

Or if you really want to get a console, search for your country in these 2 maps. If you?re grey, that means online gaming is not possible for you, my friend.

FedEx to add 20,000 holiday season workers

FedEx Corp said on Monday it plans to hire 20,000 seasonal workers, the same as last year, to handle holiday shipping volume that it expects will be up more than 13 percent.

An ongoing increase in e-commerce and last-minute orders amid a slow-growing economy will mean more deliveries for companies like FedEx that can handle fast shipments.

FedEx, which is closely watched as an indicator of consumer demand and economic health, anticipates handling more than 280 million shipments during the holiday season between Thanksgiving and Christmas.

The company said the impact of an increase in holiday shipments was included in its fiscal 2013 earnings outlook.

For the second time this year, FedEx cut its forecast for global growth in 2013, citing slower growth in China, recession in some European economies and high energy prices.

FedEx can add the same number of seasonal workers as last year because it has been hiring staff throughout 2012, especially at the Ground and SmartPost divisions that will handle the bulk of the holiday volume, said T. Michael Glenn, executive vice president of market development and corporate communications.

December 10 is expected to be its busiest day ever with some 19 million shipments - a 10 percent increase from last year.

E-commerce will drive the shipping volume on so-called "Green Monday," which falls on the second Monday of December and kicks off the heaviest online shipping week of the year.

As more shoppers buy their holiday gifts on the Internet or via mobile phone, it means higher shipping volume for FedEx and United Parcel Service - both of which have delivery contracts with most of the biggest Internet retailers.

Delivery volumes for FedEx's busiest day of the year have consistently grown, and will be nearly double the 9.8 million shipments it handled in 2005.

U.S. retail sales are expected to rise 4.1 percent this holiday season, though a slower pace than in prior years, according to the National Retail Federation.

Online holiday sales, excluding travel, are expected to increase 16.8 percent from last year to as much as $54.5 billion, FedEx said, citing eMarketer data.

"We always see a significant push for last-minute orders, and a lot of it has to do with procrastination, which for FedEx is a good thing during the holiday season," Glenn said in an interview.

Global economic weakening and concerns about expiring tax cuts in the United States could keep many consumers on the hunt for discounts and waiting until the last minute to order holiday gifts.

Retailers are keeping inventory fairly lean, so a jump in orders beyond expectations could boost demand for the quick deliveries that FedEx and United Parcel Service provide.

"Clearly businesses are waiting to see what happens with the election, the fiscal cliff and the election's impact on other policy decisions that may affect energy prices," Glenn said.

FedEx said 82 percent of its ground deliveries are shipped in three business days or less, 61 percent are delivered in 2 business days or less, and 24 percent are delivered the next business day.

Large chain stores including Toys R us, Wal-Mart Stores Inc and Macy's Inc have announced plans to add more holiday workers this year, based on the view that consumers will spend modestly more than last year as the economy mends gradually.

"There are a lot of high-tech products out there and people are saving money in other places to spend on these goods," Glenn said. "We certainly are expecting a strong peak season for FedEx."

UPS, the largest package delivery company, could give insight into its seasonal hiring plans when it reports quarterly results on Tuesday.

UPS added about 55,000 workers for the holidays last year, 10 percent more than it hired in 2010.

Make a Halloween Video Mirror Effect If you want to have a crowd-pleasing special effect at your Halloween event consider using inexpensive LCD monitors and an Ikea frame to create the illusion of a disembodied face staring out of the mirror.

Instructables user DavidAndora created an effect using three monitors along a single wall with the video synced so that the face only appeared in one frame at a time. To create the illusion he purchased an inexpensive 19-inch LCD monitor and attached it to an Ikea Ung Drill frame and then created a wall mount from a sheet of plastic to match the design of the frame and hide the dimensions of the display. He then painted everything in a fluorescent color and had the image lit by UV light to help complete the illusion. The video of the disembodied head is a friend wearing a black t-shirt over his neck so that only his face is visible.

Once the display is constructed and the video shot all you need to do is properly light the display and play the video on a loop. If you want to have multiple displays then you also need to account for syncing. The Instructables author used Final Cut to create three DVDs, each slightly delayed so that when playing the three DVDs at the same time the footage of the mysterious face only appears on one display at a time.
